Our specialist business immigration law solicitors advise organisations in the charities sector on a range of business immigration issues relating to sponsoring overseas workers and right to work queries.

Our expertise and recent work includes:

  • Advising faith-based organisations on religious work routes specifically, how to sponsor workers such as Ministers of Religion and temporary workers to include religious workers.
  • Advising a multi academy trust sponsoring a maths worker where right to work had been lost following expiry of a visa.
  • Dealing with the situation where a sponsor licence is refused, suspended or revoked.
  • Advising on employer sponsor reporting and record keeping obligations.
  • Preventing illegal working – advising on right to work checks and providing related employment advice on fair termination when existing staff no longer have a right to work.
  • Responding to Home Office enforcement action.
  • Implementing and maintaining HR systems which comply with Home Office guidance for organisations with a sponsor licence.
  • Training for staff on:
    • the sponsorship licence process
    • sponsorship licence compliance obligations;
    • pros and cons of having a sponsor licence at UK wide/group/location/company level; and
    • conducting right to work checks.
  • Advising on business immigration issues arising on TUPE transfers, group re-organisations and corporate transactions.
  • Providing briefing notes and fact sheets on preparation for compliance visits.
  • Reviewing and drafting employer sponsorship and right to work check policies and procedures.
  • Providing detailed advice on proposed employer sponsorship criteria, policies and plans to facilitate recruitment, advising on the risk of race discrimination claims and advising on a clear way forward to mitigate against such risks.
  • Advising on the appropriate occupation code and minimum salary for different sponsored worker roles.

Hazel worked through a number of Right To Work questions that we had.  We have conflicting/vague information from the Home Office and Hazel was able to respond to all of our questions and advise how to approach each scenario by either eliminating or reducing our risk. Hazel was methodical and explained things in detail so that we understood the reasons for her advice. Great support from Hazel on Right to Work – Thank you, the team are now confident in their approach going forward. – Thera Trust
